Can Obama use DOJ lawyers to defend himself against eligbility lawsuits?

I just received a fund-raising email from United States Justice Foundation (www.usjf.net) who seem to be doing the Lord's work.
It says that O is using DOJ lawyers, at taxpayers expense, to defend him against the USJF eligibility lawsuit.
It seems to me that his defense should be a personal expense for him. Does anyone on FR have any knowledge of the legality of this?
If it's legal, it's totally outrageous and infuriating.
